Please read these Terms of Service ("Terms" or "Terms of Service") carefully before using https://arkimedes.network and/or Services operated by Arkimedes Network (“Arkimedes”, “we”, “us”, and “our”) such as APIs, and mobile and desktop applications, collectively referred to as the “Services”.

By accessing or using the Services, you agree to the following Terms and Conditions:

1. Our Services

Arkimedes Network provides customers with a non-exclusive, non-transferable license, allowing them to utilize its Services. Furthermore, the usage of Arkimedes APIs is strictly limited to the development and implementation of software applications that interact with the Arkimedes Network platform, ensuring there is no conflict of interest with our Services.

2. Ownership of Intellectual Property

All intellectual property rights, including but not limited to copyrights, trademarks, and patents, in and to the APIs, Services, Data, and any related documentation belong solely to Arkimedes Network. You shall not acquire any right, title, or interest in the APIs and Services except for the limited license granted in this Agreement.

3. Restrictions

You may not sell, lease, license, distribute, or sublicense the APIs, Services, or any portion thereof. You may not modify, reverse engineer, decompile, or disassemble the APIs, Services, or any portion thereof. Furthermore, you may not use the APIs and Services for any illegal or unauthorized purpose. You shall comply with all applicable laws and regulations when using the APIs and Services.

4. Disclaimer of Warranties

The APIs and Services are provided “as is”, without warranties of any kind, either expressed or implied. Arkimedes Network is not liable for any indirect damages arising out of the use of the APIs and Services to the extent permitted by applicable law. Arkimedes Network is also not responsible or liable for any failure of the Service due to unforeseen circumstances or causes beyond its reasonable control. Arkimedes Network does not warrant that the APIs and Services will meet your requirements or that the operation of the APIs and Services will be uninterrupted or error-free.

5. Limitation of Liability

In no event shall Arkimedes Network be liable for any indirect, special, incidental, or consequential damages arising out of or in connection with your use of the APIs and Services, even if Arkimedes Network has been advised of the possibility of such damages. In any event, the total liability of Arkimedes Network for any and all claims arising out of or in connection with these terms and conditions or the use of the APIs and Services shall not exceed the amount paid by you, if any, to Arkimedes Network for the use of the APIs and Services.

6. Prohibited Actions

When using the Arkimedes Network APIs and Services, you shall not engage in any of the following actions:

• Introduce viruses, worms, Trojan horses, or other harmful and disruptive codes or programs;
• Attempt to gain unauthorized access to the APIs, Services, or any related systems or networks;
• Interfere with or disrupt the integrity or performance of the APIs, Services, or any related systems or networks;
• Use the APIs or Services to engage in or facilitate any illegal activity or activities that violate the rights of others;
